1. Acceptance of Terms

By downloading, installing, or using Createy ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Createy is a macOS application that provides AI-powered image generation capabilities. The service uses cloud-based AI models to generate images based on user prompts and inputs.

3. Account and Subscription

Account Creation: You must create an account using a valid email address or sign in with Apple/Google to use the App's features.

Subscriptions: Paid subscriptions are billed monthly or yearly through Stripe. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.

Credits: Subscription plans include monthly credits that can be used for AI generations. Unused credits do not roll over to the next billing period.

Refunds: Due to the nature of digital services, refunds are generally not provided. However, we may consider refunds on a case-by-case basis for technical issues.

4. Acceptable Use

You agree NOT to use Createy to:

  • Generate illegal, harmful, or offensive content
  • Create content that infringes on intellectual property rights
  • Generate deepfakes or misleading content of real individuals
  • Produce content depicting minors in inappropriate contexts
  • Circumvent usage limits or abuse the service
  • Reverse engineer or attempt to extract AI models
  • Resell or redistribute generated content claiming it as AI-service output

We reserve the right to terminate accounts that violate these terms without refund.

5. Intellectual Property

Your Content: You retain ownership of the prompts you submit and the images you generate using Createy.

Commercial Use: All subscription plans include a commercial license. You may use generated images for personal and commercial purposes.

Our Property: The Createy application, branding, and underlying technology remain our intellectual property.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The App requires an internet connection and depends on third-party AI services. We may modify, suspend, or discontinue features with reasonable notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATEY IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS.

8. Indemnification

You agree to indemnify and hold harmless Createy, its operators, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these terms.

9. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance of the new terms.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
